City lays charges caused by faulty construction to Rocky Mountain Court

Today, The City laid charges under the Safety Codes Act of Alberta related to construction work carried out in 2011 which created an unsafe condition; specifically compromising the structural integrity of the parkade at Rocky Mountain Court, and placing public safety at a high risk by failing to notify the owners, the businesses, the public and the authorities that faulty construction work undermining the structural integrity of the parkade had occurred.
“We are extremely disappointed that such a routine renovation went so wrong,” says Kevin Griffiths, manager Building Regulations and Chief Building Official for The City of Calgary. “From the start, public safety was disregarded and that is unacceptable. The City will continue to take legal action where unsafe conditions exist.”
There were five companies charged with seven counts of infractions of the Alberta Building Code including: The condominium owners for Rocky Mountain Court, Maverick Condominium Property Management, Williams Engineering, Durwest Construction Systems and Champion Concrete Cutting.

The Condominium Owners were also charged with two additional infractions, namely failure to ensure all permits required for work being carried out were obtained; and failure to give notice to the authorities on the date the work was carried out.
The City wants to remind the public, including condo owners; they are responsible for ensuring contractors have obtained the required permits prior to commencing work.
Background: In June 2011, resurfacing of the level 2 parkade at Rocky Mountain Court began. The structural integrity of the parkade floor was compromised as a result of negligent repair. It was only as a result of the City of Calgary discovering the unsafe condition that occupants in the seven main floor businesses and parkade levels 1, 2 and 3 were directed to vacate these floors within hours as a precautionary measure to protect public safety. Floors 4 and above were not and are still not affected by this incident.
